Terms of Service

Welcome to Axis, a service provided by cmds.media, accessible at axis.cmds.media. By accessing or using Axis, you agree to be bound by these Terms of Service and our Privacy Policy, which together constitute the entire agreement between you and cmds.media and supersede any prior agreements or understandings. Who Can Use Axis

Axis is intended for users who are at least 13 years old. By using our services, you represent and warrant that you meet this age requirement. If you are under the age of 18, you represent and warrant that you have obtained consent from your parent or legal guardian to use the Service and that they have agreed to these terms on your behalf.

Usage Guidelines

We ask that you use Axis responsibly and in good faith. To keep things safe for everyone, please don't:

• Use Axis for anything illegal or in a way that breaks any applicable laws or regulations.
• Harass, abuse, threaten, spam, or harm others in any way using the Service.
• Upload, share, or transmit anything harmful, including malware, viruses, or other malicious code.
• Use Axis to send spam, phishing attempts, or any other unsolicited communications.
• Upload or make available content that infringes on someone else's intellectual property rights.
• Try to gain unauthorized access to Axis, our servers, or any connected systems or infrastructure.
• Scrape, crawl, or automatically collect data from the Service without permission.
• Reverse engineer, decompile, or attempt to extract source code or underlying systems from Axis.
• Interfere with or disrupt how the Service works, including any servers, networks, or infrastructure behind it.
• Use Axis in a way that violates Discord's Terms of Service, whether directly or through the Discord bot or website.
• Violate the terms of service of any other third-party providers used within the Service.
• Use Axis in a way that violates the rights of any other third party.

Account Information

In order to access certain features of the Service, you may need to be logged in with your Discord account. We store your account information in accordance with our Privacy Policy.

You are responsible for maintaining the confidentiality of your account credentials, such as your password and account tokens, and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account. We are not responsible for losses resulting from unauthorized access caused by compromised Discord accounts or user-side security failures.

User Content

When you use Axis, you may upload or provide content through the dashboard or via Discord. This includes images, text, configurations, and anything else you submit to the Service ("User Content"). You retain full ownership of your Content. We don't claim any rights to it beyond what's needed to run the Service.

By submitting content to Axis, you grant cmds.media a non-exclusive, worldwide, royalty-free license to store, display, modify, and process your Content as necessary to provide the Service. This includes things like processing images you upload, displaying content on server pages, or modifying files as part of a bot feature you've requested.

You're responsible for making sure you have the rights to any content you submit. Please don't upload or share anything that infringes on someone else's copyright, trademark, or other intellectual property rights.

Copyright & DMCA

We respect intellectual property rights and will respond to valid notices of copyright infringement. If you believe content available through Axis infringes your copyright, you may submit a notice through our support form.

To be considered, your notice must include all information required under the Digital Millennium Copyright Act (DMCA), including identification of the copyrighted work, the allegedly infringing content, and your contact information. We are not obligated to act on notices that are incomplete, inaccurate, or submitted in bad faith.

Where we determine a valid claim has been made, we may remove or disable access to the reported content. Users who repeatedly infringe on the rights of others may have their access to the Service suspended or terminated.

We reserve the right to decline further correspondence with anyone who submits abusive, fraudulent, unauthorized, or repeatedly invalid notices.

Intellectual Property Rights

Axis and everything that makes it work, such as the bot, the dashboard, the underlying code, design, and brand, belong to cmds.media. You're welcome to use the service, but please don't copy, reproduce, or build something based on it without permission.

Termination

You can stop using Axis at any time. Just remove the bot from your server and stop using the dashboard. You can also request that we delete your data via our support form.

We reserve the right to suspend or terminate your access to Axis if you violate these terms or use the service in a way that harms others or the platform. We try to be thoughtful and considerate about this, but certain violations such as abuse or illegal activity may result in immediate termination.

Even after your access to Axis ends, certain parts of these Terms, including sections covering liability, intellectual property, and dispute resolution, will still apply.

Termination of your account may result in the deletion of any associated data, content, or preferences, and will be handled in accordance with our Privacy Policy.

Enforcement Transparency

In cases where access is suspended or terminated, we may disclose limited information about the enforcement action as described in our Privacy Policy under "How We Share Your Data".

Termination Appeals

If you believe your access has been suspended or terminated in error, you may submit an appeal through our support form.

Appeals are reviewed at our discretion and we make reasonable efforts to respond in a timely manner. However, we are not obligated to respond to every submission, particularly in cases of clear or repeated violations.

If we determine that an enforcement action was taken in error, we may reinstate your access to the Service and, if possible, any associated data or content that was removed.

Automated Enforcement

We may use automated systems to detect violations of these Terms, including but not limited to abuse, spam, ban evasion, and excessive or unauthorized use of the Service. If such systems detect potential violations, we may take automatic and immediate action, including suspension or termination. If you believe an automated enforcement action was taken in error, you may submit an appeal through the process described above.

Indemnification

You agree to defend, indemnify, and hold harmless Axis, cmds.media, and its operators from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of Axis, your User Content, or your breach of these Terms. This applies whether or not such claims are brought by other users, third parties, or any other entity.

Disputes

If a dispute arises, we'd prefer to resolve it directly. You can reach out to us first via our support form.

If a formal resolution is necessary, it will be handled in accordance with West Virginia law, using the English version of these terms as the authoritative reference.

Privacy Policy

By using Axis, you agree to our Privacy Policy, which is referenced in these Terms. It covers what information we collect, how we use it, and when we may disclose it.

Amendments

We reserve the right to modify or update these Terms of Service at any time and for any reason. However, we will attempt to notify you via means such as on the website or via the Discord bot. Any changes to these terms will be effective immediately upon posting the revised terms on the Service. Your continued use of the Service after the posting of any revised terms constitutes your acceptance of such changes.

We reserve the right to modify, suspend, or discontinue the Service or any part of it at any time without notice or liability.

Third-Party Services

Some features of Axis integrate with or depend on third-party platforms. These platforms have their own terms of service and privacy policies, which you are responsible for reviewing and complying with. We are not responsible for the availability, accuracy, or conduct of any third-party service, and any disruption or change to those platforms may affect related features in Axis.

Accuracy of Data

Some features of Axis may display information sourced from third-party providers or derived from cached data, including but not limited to exchange rates, configurations, and logs. This information may be delayed, incomplete, or inaccurate. We make no representations or warranties regarding the accuracy, completeness, or timeliness of any such data. For anything where accuracy or recency matters, you should verify with an authoritative source.

Disclaimers

Axis is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the Service will be error-free, uninterrupted, secure, or free of harmful components. You use Axis at your own risk. We are not responsible for any damage or data loss that may result from using the Service, including issues affecting your devices or stored data.

To the maximum extent permitted by law, we disclaim all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that Axis will meet your specific requirements or expectations, or that it will operate in any specific environment or use case.

Information presented on the Service, including but not limited to feature descriptions, statistics, and other marketing material, may not always reflect the current state of the Service and is provided for general informational purposes only.

Limitation of Liability

To the maximum extent permitted by law, cmds.media and its operators are not responsible for any indirect, incidental, special, consequential, or punitive damages that may arise from your use of Axis. This includes things like loss of data, loss of access, loss of profits or revenue, or any other intangible losses, whether the issue comes from your use or inability to use the Service, unauthorized access to systems or data, or any other situation connected to the Service.

Since Axis is provided free of charge, the maximum liability we can have toward you for any claim related to the Service is limited to what you've paid us, which is zero.

Force Majeure

We are not liable for any failure to perform our obligations where that failure results from circumstances beyond our reasonable control, including but not limited to internet outages, power failures, natural disasters, third-party service disruptions, or communications failure or degradation.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be made in writing to be effective.
